Muslim side reached Allahabad High Court, and challenged the decision of the district court

Five cases related to the Gyanvapi dispute are already pending in the Allahabad High Court, in which the Allahabad High Court has reserved the judgment after the completion of the arguments in three cases. Whereas in two cases related to the survey of the disputed premises, a hearing is to be held on October 18 in the Allahabad High Court. However, Rakhi Singh's case has come to the threshold of the High Court for the first time.

New Delhi: The Allahabad High Court has challenged the decision of the District Judge of Varanasi on a petition seeking permission to allow regular worship of Shringar Gauri in Gyanvapi campus of Varanasi. The Muslim side has reached the Allahabad High Court against the decision from the district judge's court. The Muslim side has challenged the decision of dismissal of the objection application in the Allahabad High Court.


An appeal has been filed in the Allahabad High Court on behalf of the Anjuman-e-Avanjariya Committee of the Gyanvapi Masjid, seeking a stay on the ongoing hearing in the district court of Varanasi till the High Court's decision. In the case of Order 7 Rule 11, the decision which came on September 12 has been challenged in the High Court. On October 18, the Allahabad High Court may hear the matter on the application of the Arrangement Committee of the Gyanvapi Masjid.


It is noteworthy that 5 women including Rakhi Singh of Delhi had filed a petition in the district court of Varanasi last year. The petitioners had filed a petition seeking permission to regularly offer prayers to Shringar Gauri, located in the Gyanvapi complex. On the orders of the Supreme Court, the hearing of this case is going on in the court of the District Judge of Varanasi. The Muslim side filed an objection in the court and appealed to dismiss the petition of women including Rakhi Singh.


It was said on behalf of the Muslim side that this application is not fit for hearing under Order 7 Rule 11. After months of hearing, the court of District Judge Varanasi had reserved its judgment in the month of August. The court of District Judge AK Vishwesh gave its verdict on 12 September. The District Judge, rejecting the objection of the Muslim side, allowed the Rakhi Singh case to continue. Only after this decision came, the Muslim side had talked about going to the High Court. This decision of the District Judge has been challenged in the petition filed on behalf of the Muslim side.


In the petition of the Muslim side filed in the High Court, it has been reiterated once again that the matter cannot be heard under the Places of Worship Act of 1991. In the petition, there has also been a demand for a stay on the ongoing hearing in the district court of Varanasi till the High Court's decision in this matter.
